1. Introduction and Acceptance

By using zinex.in, you agree to follow these Terms of Service. This agreement is legally binding between you (the user, whether buyer, seller, or visitor) and Prakash (zinex) Commerce Pvt. Ltd. (“we,” “us,” “our”).

If you don’t agree with any part of these terms, please don’t use the website or its services.

We operate fully within Indian laws and are committed to ethical digital commerce.

3. Who can use Zinex

You must be 18 years or older to use Zinex. If you're under 18, you must use the platform under the supervision of a parent or legal guardian.

You're responsible for keeping your account details secure and for all activities done under your account. If you suspect misuse, inform us immediately.

4. What services we provide

Zinex is currently operated as a managed digital storefront, where we list digital goods and handle their delivery, support, and payment processing internally.

We do not create or own these products. All items are linked to a verified seller, distributor, supplier, or brand, and we operate as a middle layer to manage:

  • Product listing
  • Automation of delivery
  • Order and stock management
  • Customer support
  • Seller verification

Each product on Zinex is tied to one or more verified sellers or distributors, depending on the nature of the listing.

We carefully ensure that products are functional and authentic. In the case of individual sellers, we verify that the digital good originates from official or legitimate sources. If any product is reported as faulty or unauthentic, we remove it immediately and investigate.

We do not guarantee continued access to a product after the end of its lifecycle or subscription. Product validity is based on what is mentioned on the listing page.

5. Seller responsibilities under Seller Connect

Our Seller Connect program is managed by a dedicated team at Zinex, which is responsible for onboarding, reviewing, and managing all sellers, distributors, or brands. Sellers are required to:

  • Only list digital goods they legally own or have rights to resell
  • Deliver genuine, functioning products without defects
  • Maintain updated stock and pricing
  • Cooperate in case of product issues or disputes
  • Follow transparent product representation and avoid misleading claims
  • Agree to fair refund/replacement obligations if products fail
  • Accept internal penalties or delisting for any violation

All seller listings are manually moderated or added through tools connected to our internal dashboard. No seller can list on the site without prior verification.

6. Internal management structure

Zinex is currently operating in a pre-marketplace phase. This means:

  • Products, sellers, and stock are managed through internal tools
  • Seller onboarding, product listing, automation, and email delivery are handled by our in-house systems
  • Customer support and success are managed directly by our internal team
  • Transactions are processed through our secure integrated systems

Zinex only handles delivery, support, and transactions. It does not claim ownership or development rights over the original digital goods sold.

In future, Zinex will transition to a full marketplace model, where sellers will manage listings directly through dashboards, but until then, all operations are executed through our backend team and controlled systems.

7. Order process and delivery

  • Most products are fulfilled within 0–12 hours after payment.
  • Some items may take up to 24–48 hours, especially during high demand.
  • Delivery is done through email, secured access pages, or third-party integrations.
  • You will get regular status updates by email or SMS if provided.
  • Orders marked as “pre-order” follow different timelines (explained next).

8. Pre-orders and estimated delivery time

Some products are listed as pre-order if stock is being replenished or processed. These follow:

  • Delivery within 30 calendar days from purchase
  • You’ll receive at least one update before the 30th day
  • If the item isn’t delivered within that time, you can claim a 100% refund
  • If delivered and functioning, refund rules of normal orders apply

Pre-order delays caused by external vendors or API changes may occur but will be communicated.

9. Pricing, payment and taxes

  • All prices shown on Zinex are in Indian Rupees (INR)
  • Prices are dynamic and may change based on supply, demand, or market pricing
  • All prices include applicable taxes unless mentioned
  • Payment is accepted through secure third-party payment gateways like Razorpay, Cashfree, or UPI
  • We don’t store card or bank details and are not responsible for payment gateway errors or downtime
  • Any offer, coupon, or reward is subject to validity, misuse protection, and can be revoked at any time

10. Buyer protection policy

We want to ensure safe shopping. You are protected under these conditions:

  • You get a working product as promised
  • If the product doesn’t work, you can raise a request within 48 hours
  • Our team may ask for screenshots or other proof
  • If verified, you’ll receive a full refund or replacement within 3–7 days
  • Protection is void if the product was misused, resold, or shared

We reserve the right to deny refunds if the issue arises from customer misuse or refusal to follow instructions.

11. Refund and return rules

You can claim a refund or replacement if:

  • The key or subscription doesn’t work at all
  • The product is not as listed
  • Pre-order was not delivered in 30 days

You cannot claim a refund if:

  • You changed your mind after delivery
  • You misused the key (e.g., tried using on unsupported systems)
  • You didn’t read product instructions
  • The problem is due to your hardware/internet issues

Refunds are credited to the original payment method or Zinex Wallet if preferred. Zinex Wallet funds cannot be withdrawn but can be reused for future purchases.

12. What you’re not allowed to do (Prohibited Uses)

To protect the platform and its users, you must not:

  • Try to reverse-engineer, hack, or tamper with Zinex systems
  • Resell products illegally or in unauthorized ways
  • Misuse discounts, coupon codes, or referral systems
  • Use fake identities, stolen cards, or unauthorized bank accounts
  • Harass staff, sellers, or other buyers
  • Upload malicious content or links
  • Circumvent delivery systems or API triggers intentionally

Violation of any rule can lead to permanent account block, wallet lock, and legal notice.

13. Copyright and product ownership

Zinex doesn’t own the brands we list. All logos, trademarks, and product names belong to their original creators or licensors.

Our platform is just a bridge between verified sellers and buyers. If you’re a brand owner and find unauthorized listings, write to legal@zinex.in and we’ll respond within 48 hours.

14. Platform availability and liability limits

We aim for 99% uptime, but we’re not liable for:

  • Third-party platform downtime (like a game server being offline)
  • Issues in partner APIs, license servers, or email services
  • Technical bugs that delay delivery temporarily
  • Force Majeure (explained below)

Our total liability is limited to the value of the product you purchased.

15. Privacy and data handling

We collect only necessary data such as your:

  • Name
  • Email address
  • Order history
  • Phone number (optional)

We use this only for:

  • Delivering your order
  • Sending updates
  • Improving your experience

We don’t sell, rent, or misuse your data. All communication is encrypted and follows Indian data protection norms. Read our Privacy Policy for more.

16. Disputes and resolutions

If something goes wrong:

  • Email us at support@zinex.in
  • Provide your Order ID and issue details
  • Share proof like screenshots or email logs if needed
  • We’ll reply within 24–48 hours and usually resolve issues in 5–7 days

If you’re still unhappy, you may raise the issue legally, but we suggest resolving it internally first.

17. Indemnification (Your responsibility)

By using Zinex:

  • Buyers agree not to misuse products and to hold Zinex harmless in case of misuse, IP violation, or illegal resale.
  • Sellers agree to be accountable for product legality, accuracy, and delivery. They must indemnify Zinex against any brand or customer-related legal issue caused by their listings.

18. Account termination or suspension

We can block or terminate your account if:

  • You break these Terms
  • You engage in fraud or harassment
  • You are flagged multiple times by sellers or buyers
  • You attempt chargebacks without resolving the issue with support

Serious breaches may lead to permanent ban and legal action.

19. How we’ll communicate with you

We’ll reach you through:

  • Your registered email
  • SMS or WhatsApp (if opted in)
  • Website banners or dashboard alerts

For legal communication, we’ll use email or post to the address associated with your account.

20. Changes to these Terms

We may update these Terms based on feedback, legal changes, or platform upgrades. We’ll notify you through email or website alerts.

By continuing to use Zinex, you accept the new terms automatically.

21. Governing law and legal jurisdiction

These Terms are governed by the laws of India. Any legal action will fall under the jurisdiction of Patna, Bihar, where our operations are based.

22. Force Majeure clause

We are not responsible for delays or failures due to causes beyond our control, such as:

  • Internet blackout or payment gateway failure
  • Natural disasters, pandemic lockdowns
  • War or cyberattacks
  • Sudden regulatory changes
  • Server failures by third-party partners

23. Severability and waiver

If any part of these Terms is declared illegal or unenforceable, the rest remains valid.

If we don’t enforce a clause at one point, it doesn’t mean we waive our right to enforce it later.

24. Transition into a full marketplace (Coming soon)

While Zinex is currently a managed storefront operated internally, we are actively building a fully automated, open marketplace platform that will allow verified sellers to list directly under admin moderation.

Once launched, all listings, transactions, and seller-buyer interactions will happen through the platform itself with enhanced seller tools, compliance features, and more autonomy.

Until then, our internal team handles everything manually—from automation tools to stock assignment, email deliveries, and managing customer success.
